Our goal is quality of service for all of our customers. While our service has sufficient capacity to support average personal usage, if your usage is excessive relative to the average, we may need to limit your bandwidth or suspend your account. You also cannot use our service for things that could hurt our service, company or other people.

1. Acceptable Use Policy

Bandwidth Limitations

The Service has sufficient capacity to accommodate average non-commercial use. However, during periods of extraordinarily heavy usage, you may temporarily experience slower service or unavailability. Deep Quick Photography reserves the right to temporarily suspend or limit your use of the Service if your usage exceeds average levels or negatively impacts network health.

Use of the Service

You may only use the Service for personal, non-commercial purposes. You may NOT:

2. Software License Terms

Deep Quick Photography grants you a limited, nonexclusive, personal, non-transferable license to use the HappyFace software for internal and personal purposes only.

Prohibitions: You may not rent, lease, sublicense, sell, or assign the software. You may not reverse engineer, decompile, or attempt to discover the source code of the software.

3. Termination Policy

We may suspend or terminate your use of the Service in the event of any breach of these Terms. We also reserve the right to cease offering the Service at our sole discretion without prior notice.

4. Service Plan Terms

Service plans depend on the specific product features and bandwidth requirements. If you subscribe to a plan with recurring fees, failure to pay when due may lead to suspension of access. We may change fees upon 30 days' notice.

5. Apple In-App Purchases and Refunds

Subscriptions, virtual credits, and other in-app purchases completed through the Apple App Store are subject to Apple's payment and refund rules. Refund requests are reviewed and decided by Apple, and the Service Provider cannot guarantee that any refund request will be approved.

When you submit a refund request to Apple, the Service Provider may, in accordance with Apple's refund review process and the Privacy Policy, provide Apple with objective information relating to the applicable transaction. This information may include whether the purchased item was delivered, whether subscription benefits or virtual credits were used, the amount or proportion used, the remaining balance, relevant account status, and other information directly related to the refund review.

If Apple approves a refund, the Service Provider may cancel or terminate the subscription associated with the refunded transaction and deduct, freeze, revoke, or otherwise recover the virtual credits, digital content, or other benefits provided through that transaction. If any refunded credits or benefits have already been used, the equivalent amount may be deducted from your existing account balance. If your balance is insufficient, your account may show a negative balance or certain features may be restricted until the corresponding amount is restored.

You may not obtain improper benefits through repeated refund requests, continued use of refunded benefits, false statements regarding usage, or other abusive or fraudulent conduct. Where permitted by applicable law, the Service Provider may restrict purchases, credit usage, or access to certain features in response to suspected refund abuse or fraud.

7. Miscellaneous

Entire Agreement: These terms constitute the entire agreement between you and the Service Provider regarding HappyFace.

Assignment: We may assign or transfer our rights and obligations under these Terms to any person or entity without notice.
